Judicial cases from winter to spring released

The following is a summary of recent cases decided by the Judicial Board. Community Board and the College judicial coordinator:

Case #1

Hearing Date:

December 8, 1995

Hearing Body:

Judicial Board

Regulations Violated:

Section X. Social Conduct M. Misconduct 2. Behavior that cause or could cause ... loss of personal or College property, i.e., theft and Section IX. Miscellaneous Regulations H. Possession of stolen Property. Student was charged with the theft of checkbooks, wallets and bank cards from other students. Additionally, student was charged with forging and cashing checks totaling $400.

Disposition:

Student acknowledged that he had committed these offenses. Student is suspended for two semesters. During that time student is not permitted to be on college property. Student is required to submit a written statement to the judicial board before being reinstated. Statement is to include student's thoughts on trust and community.

Student appealed this decision. The appeal was denied.

Case #2

December 14, 1995

Hearing Body:

Hearing Officer

Regulations Violated:

Section VII. Library, Audiovisual Services and Computing Center 4. Theft and/or mutilation. Student was charged with attempting to leave the library with a book that was not checked out to the student. The barcode and bookplate were also torn off. Disposition:

Student was found to be responsible for this offense. Student is required to pay for the damage to the book. Student is also required to meet with library staff to discuss the ramifications of student's actions. There was no appeal.

Regulations violated:

X. Social conduct. M. Misconduct 1. Threats to physical or mental well-being of members of the College community. e.g., physical assault. Student was charged with kicking complainant in the back. Disposition:

Student was found to be responsible as charged. Student is placed on probation for remainder of academic year. Student is required to pay complainant's emergency room bill.

Case #4

March 18, 1996

Regulations Violated:

Section X. Social Conduct, a. Threats to physical or mental well-being of members of the College Community. e.g., physical assault. Student was charged with physically assaulting another student during a heated confrontation. Disposition:

Student was found to be responsible as charged. Student is placed on disciplinary probation for the remainder of the academic year. Student is to express in writing his feelings to the other student and submit to the judicial coordinator. Student is also encouraged to pursue mediation with the other student. Student is encouraged to take advantage of the numerous resources available on campus in order to effectively address feelings of anger, frustration and stress without harming self or others. There was no appeal.

Case #5

Regulations Violated:

Section X. Social Conduct. M. Misconduct. Misconduct is behavior that interferes with the rights of others. 1. Threats to physical or mental well-being of members of the College Community. 2. Behavior that causes or could cause loss of personal or College property, 3. Interference with the essential educational process of the College. Student was charged with repeated use of marijuana in residence hall room, possession of drug paraphernalia harassment of residence hall staff, destruction of personal property and non-compliance with the order of a College official. Disposition:

Student was found to be responsible for several of these charges, specifically, repeated use of marijuana, possession of drug paraphernalia, disrespect for the rights of others, and non-compliance with the order of a College official. Student may not return to College housing for the remainder of this semester. Student is placed on disciplinary probation for remainder of Oberlin College enrollment. Student is suspended from Oberlin College for the first semester of the 1996-97 academic year. Upon returning to Oberlin, student may not live off-campus or remainder of college enrollment.

Student appealed the decision. Appeal was denied.

Case #6

March 20, 1996

Hearing Body:

Judicial Board

Regulations Violated:

Section X. Social Conduct, K. Alcohol, Drug and Tobacco Policy and Section II. Housing and Dining Regulations. Student was charged with smoking marijuana in the residence hall room and with covering the smoke detector in the room. Disposition:

Student was found to be responsible and a letter of admonition will be placed in student's file for the remainder of the semester and for the next semester that student is enrolled. Student is required to read the Student Regulations, Policies and Procedures, specifically the regulations that were violated, and provide a two page paper about the regulations regarding smoking in a residence hall room, use of illegal drugs in a residence hall room and tampering with fire safety equipment. The paper should address why the regulations exist and possible penalties for violation of the regulations. The paper is to be submitted to the judicial coordinator. There was no appeal.

Case #7

Hearing Date:

April 10, 1996

Hearing Body:

Judicial Board

Regulations Violated:

Section X. Social Conduct, M. Misconduct. Student was charged with stealing items from a co-op and with assaulting the complainant.

Disposition:

Student was found to be responsible for theft and for biting complainant. The board found that both complainant and accused were engaged in improper physical contact. Student is required to perform 6 hours of service to the Oberlin Hot Meals Program. Assignment must be completed before commencement. There was no appeal.

Case #8

April 18, 1996

Hearing Body:

Judicial Board

Regulations Violated:

Section X. Social Conduct M. Misconduct 2. behavior that causes or could cause damage to, or loss of, personal or College property, e.g., theft. Student was charged with stealing food from a co-op.

Disposition:

Student was found to be responsible for this behavior. Student must perform 12 hours of community service at the Oberlin Community Hot Meals Program. Assignment must be completed before commencement. Student was placed on probation for the remainder of the semester. There was no appeal.

Case #9

May 8, 1996

Hearing Body:

Judicial Board

Regulations Violated:

Section X. Social Conduct M. Misconduct. and K. Alcohol, Drug and Tobacco Policy. Student was charged with several incidents of alcohol related disruptive behavior in Wilder Hall. Subsequent to charges being filed an pending judicial hearing, student again engaged in alcohol related disruptive behavior in Wilder Hall, causing the student to be banned from Wilder.

Disposition:

Student is suspended for the fall 1996 semester. When student returns to Oberlin, student will remain on disciplinary probation for the remainder of Oberlin College career. It is highly recommended that the student seek professional help for the alcohol problem.

Case #10

May 6, 1996

Community Board

Regulations Violated:

Section X. Social Conduct M. Misconduct 1. Threats to physical or mental well-being of members of the college community, e.g. threats of violence, excessive noise, harassment. 2. Behavior that causes or could cause damage to, or loss of, personal or College property e.g., vandalism. IX. judicial System 3c1. Behavior which disrupts or materially interferes with the exercise by others of the basic rights to which they are entitled on College property. 4. Behavior which causes or can reasonable be expected to cause physical harm or damage to property or is unreasonably disruptive. 16. Repeated disorderly behavior as a result of alcohol or drug use. 19. Repeated instances of verbal abuse. Students were charged with several instances of misconduct, specifically with being drunk, disorderly and verbally abusive and with frightening and disturbing other students. Disposition:

Students were found to be responsible for drunken, disorderly conduct and for making harassing, abusive telephone calls to other students, frightening and upsetting those students who were their targets.

One student already has sanctioned levied due to previous judicial action. Therefore that student is suspended immediately for the remainder of the semester and for the 1996-97 academic year. Upon student's return to Oberlin College, the student will be placed on disciplinary probation for the remainder of student's time at Oberlin. Student must also negotiate and sign a behavior contract with Residential Life.

One student is placed on immediate disciplinary probation and will remain on probation for the remainder of student's career at Oberlin College. Additionally, the student is suspended for the fall 1996 semester.

These decisions arise from an appeal hearing, therefore no further appeal is possible.
